Why is a background search necessary?

In addition to the safety and well being of their employees, employers are now being held responsible for the safety of their customers and anyone who may be affected or harmed by the actions or negligence of an employee on duty.

There's better than a 50-50 chance that whatever state you're reading this in now is a state that upholds the Negligent Hiring Doctrine. At last count, approximately twenty-eight out of fifty states legally recognize that an employer is responsible for, and can be held accountable for, checking the background and references of any job applicant before placing that applicant in a position of high public contact.


Negligent hiring is a cause of action in tort law that arises where one party is held liable for negligence because they placed another party in a position of authority or responsibility, and an injury resulted because of this placement.

Negligent hiring is generally found where the employee who actually caused the injury had a reputation record that showed his propensity to misuse the kind of authority given by the employer, and this record would have been easily discoverable by that employer, had a diligent search been conducted. For example, a victim of sexual harassment in the workplace may have a cause of action for negligent hiring on the part of her employer if she can show that the employer was aware of the harasser's termination from a previous position for the same behavior.

WHAT IS COMPETITIVE INTELLIGENCE ?

Introduction : Also known as business intelligence.

No business is an island. For success, the business will need to deal with customers, suppliers, employees, and others. In almost all cases there will also be other organisations offering similar products to similar customers. These other organisations are competitors. And their objective is the same - to grow, make money and succeed. Effectively, the businesses are at war - fighting to gain the same resource and territory : the customer. And like in war, it is necessary to understand the enemy:

  how he thinks;
  what his strengths are;
  what his weaknesses are;
  where he can be attacked;
  where the risk of attack is too great....

and so on. And like in war, the competitor will have secrets that can be the difference between profit and loss, expansion or bankruptcy for the business. Identifying these secrets is thus crucial for business survival. But all this is not new...

Customer's usually know the differences between companies - their good points and bad points. They know that company A is cheaper than company B and that company C has a better after-sales service.
